ABSTRACTThis paper examines Nishida’s later work on the historical world and religious transformation in an effort to clarify his political writings during the Pacific War. It sheds new light on the debate over the interpretation of Nishida’s wartime actions through reflection on a brief interaction Nishida had with the student Kiyoshi Kato during World War II. Shinran’s influence on Nishida will also be analyzed to reveal that the moral and religious insufficiency of the practitioner is a key aspect of his (...) view of religious consciousness. Considering Nishida’s view of religious transformation together with his political writings and his interaction with Kato will lead to a deeper understanding of his view of history. (shrink)

This article explores how abortion bans in states with large Black populations will exacerbate existing racial inequities in those states’ child welfare systems.

This interdisciplinary course, which included students from medicine, public health, law, and public policy, explored the concept of “prevention” and the role of law and public policy preventing disease and injury and improving population health. In addition to interdisciplinary course content, students worked in interdisciplinary teams on public health law and policy projects at community organizations and agencies.

This article traces the development and growth of health justice partnerships (HJPs) in three countries: the United States, Australia and the United Kingdom.

More than half of all intimate partner homicides involve a firearm and firearms are frequently used by perpetrators of intimate partner violence (IPV) to injure and threaten victims and survivors. Recent court decisions undermine important legal restrictions on firearm possession by IPV perpetrators, thus jeopardizing the safety of victims and survivors. This article reviews the history and recent developments in the law at the intersection of IPV and firearm violence and proposes a way forward through a health justice framework.

This article describes overlapping links among incarceration, poor health, race, and stigma, and stigma's impact on the health of former prisoners and their families and communities. The authors include policy recommendations to reduce the impact of incarceration and stigma.

This article discusses how advocacy can be taught to both law and public health students, as well as the role that public health law faculty can play in advocating for public health. Despite the central role that advocacy plans in translating public health research into law, policy advocacy skills are rarely explicitly taught in either law schools or schools of public health, leaving those engaged in public health practice unclear about whether and how to advocate for effective policies. This article describes a new type of medical-legal partnership (MLP) that targets the health and justice concerns of people enmeshed in the U.S criminal justice system: a partnership between clinicians who care for people with criminal system involvement and public defenders. This partnership offers an opportunity to not only improve patient health outcomes but also to facilitate less punitive court dispositions, such as jointly advocating for community-based rehabilitation and treatment rather than incarceration.

Genome editing with engineered nucleases (GEENs) introduce site‐specific DNA double‐strand breaks (DSBs) and repairs DSBs via nonhomologous end‐joining (NHEJ) pathways that eventually create indels (insertions/deletions) in a genome. Whether the features of indels resulting from gene editing could be customized is asked. A review of the literature reveals how gene editing technologies via NHEJ pathways impact gene editing. The survey consolidates a body of literature that suggests that the type (insertion, deletion, and complex) and the approximate length of indel edits (...) can be somewhat customized with different GEENs and by manipulating the expression of key NHEJ genes. Structural data suggest that binding of GEENs to DNA may interfere with binding of key components of DNA repair complexes, favoring either classical‐ or alternative‐NHEJ. The hypotheses have some limitations, but if validated, will enable scientists to better control indel makeup, holding promise for basic science and clinical applications of gene editing. In Perception: First Form of Mind, Tyler Burge develops an understanding of the most primitive type of representational mind: perception. Focusing on its form, function, and underlying capacities, as indicated in the sciences of perception, Burge provides an account of the representational content and formal representational structure of perceptual states, and develops a formal semantics for them. The account is elaborated by an explanation of how the representational form is embedded in an iconic format. These structures are then situated (...) in current theoretical accounts of the processing of perceptual representations, with an emphasis on the formation of perceptual categorizations. An exploration of the relationship between perception and other primitive capacities-conation, attention, memory, anticipation, affect, learning, and imagining-clarifies the distinction between perceiving, with its associated capacities, and thinking, with its associated capacities. I shall propose five theses on de re states and attitudes. To be a de re state or attitude is to bear a peculiarly direct epistemic and representational relation to a particular referent in perception or thought. I will not dress this bare statement here. The fifth thesis tries to be less coarse. The first four explicate and restrict context- bound, singular, empirical representation, which constitutes a significant and central type of de re state or attitude.

In this paper I take up the task, begun by Lewis and Lewis in their seminal paper on the topic, of offering a theory of holes according to which a hole is simply its hole-lining. I begin by motivating the theory, arguing that it holds interest even absent its original animating concerns of nominalism and materialism, and present desiderata any such theory must satisfy. With this in place, I offer a definition both of a lining and of hole sameness, arguing (...) that these can overcome the most prominent standing objections to identifying holes with linings. Finally, I present a more powerful counterargument in the spirit of Casati and Varzi, and conclude with an emended version of the theory meeting all our earlier desiderata. Sexual assault is a common experience for women and a significant topic for feminist scholarship. However, discussions of forensic evidence collection have been largely neglected. This paper considers the ethics of forensic evidence collection by situating the conversation in the context of the experience of sexual assault. The power of patriarchal norms and rape myths, the impact of trauma, and the systemic sexism in the medical and legal systems are also discussed. Tyler Burge presents an original study of the most primitive ways in which individuals represent the physical world. By reflecting on the science of perception and related psychological and biological sciences, he gives an account of constitutive conditions for perceiving the physical world, and thus aims to locate origins of representational mind.

Advancements in biological ageing research have shown that age-related diseases may be fought more effectively in the future by directly intervening into the ageing process. This prospect is associated with hopes for solving problems of demographic change. It also addresses raising awareness for complex ethical, legal and social issues that have hardly been a topic of discussion to date. Therefore, as the objective of our project, an interdisciplinary discourse module entitled “Ethics of Biogerontology” was developed to initiate a social debate (...) on the ethical, legal, and societal implications of biogerontology. The discourse module focuses on competences and argumentation skills and was developed with experts from relevant disciplines, e.g. biogerontology, social gerontology, philosophy, geriatrics, and medical ethics. Concepts of age and ageing are tightly interlinked with biogerontology and are as such relevant as teaching contents of the discourse module. The course module was tested in eight discourse teaching projects in research, medicine, and education in various partner institutions and evaluated based on an ethical competence model. This article describes the conception, including the learning objectives, of such a teaching course and the associated teaching contents. It also gives a justification for their selection. This book provides the English-speaking world with a comprehensive account of the still largely unknown work of Schelling’s philosophy of mythology and revelation. Its achievement, however, is not archival but philosophical, elucidating the relation between Schelling and onto-theology. It explains how Schelling dealt with the problem of nihilism and onto-theology well before Nietzsche and Heidegger, arguing that Schelling surpasses onto-theology or the philosophy of presence a century prior to Heidegger. Overall, the author provocatively suggests that Heidegger is perhaps Schelling’s genuine (...) heir and by comprehensively interpreting Schelling’s multifaceted late lectures he analyzes issues as diverse as the Ancient relation between thinking and Being, the Medieval debate between voluntarism and intellectualism, the overcoming of modern subjectivism and German Idealism as well as many themes in contemporary philosophy. In this paper I propose and motivate a logic of the interdefined concepts of making true and control, understood as intensional propositional operators to be indexed to an agent. While bearing a resemblance to earlier logics in the tradition, the motivations, semantics, and object language theory differ on crucial points. Applying this logic to widespread formal theories of agency, I use it as a framework to argue against the ubiquitous assumption that the strongest actions or options available to a given (...) agent must always be pairwise incompatible. The conclusion is that this assumption conflicts with failures of higher order control of agents over their degree or precision of control, failures exhibited by such imperfect agents as ourselves. I discuss models in this setting for understanding such imperfectly self-controlling agents. In an appendix, I prove several relevant results about the logic described, including soundness and completeness both for it and for certain natural extensions. (shrink)

Abstract: In this paper I argue that luck and fortune are distinct concepts that apply to different sets of events. I do so by suggesting that lucky events are best understood as significant events that are either modally fragile or improbable (depending on whether you accept a modal account or a probability account of luck), whereas fortunate events are best understood as significant events that are outside of our control. I call this the Pure Control Account of Fortune. I show (...) that this account of fortune forces control theorists about luck to be fortune reductionists but allows those who endorse a modal or probability account of luck to be fortune realists. Additionally, I argue that this account of fortune helps us overcome prominent counterexamples and challenges found in the luck literature. (shrink)

Non‐Humean theories of natural necessity invoke modally‐laden primitives to explain why nature exhibits lawlike regularities. However, they vary in the primitives they posit and in their subsequent accounts of laws of nature and related phenomena (including natural properties, natural kinds, causation, counterfactuals, and the like). This article provides a taxonomy of non‐Humean theories, discusses influential arguments for and against them, and describes some ways in which differences in goals and methods can motivate different versions of non‐Humeanism (and, for that matter, (...) Waiting time is widely used in health and social policy to make resource allocation decisions, yet no general account of the moral significance of waiting time exists. We provide such an account. We argue that waiting time is not intrinsically morally significant, and that the first person in a queue for a resource does not ipso facto have a right to receive that resource first. However, waiting time can and sometimes should play a role in justifying allocation decisions. First, there (...) is a duty of fairness prohibiting line-cutting where a sufficiently just queue exists. Second, waiting time has several morally attractive features that can justify its incorporation into allocation schemes. Where candidates are in relevantly similar circumstances, allocating by waiting time is relatively efficient, maximizes distribution equality relative to other Pareto efficient distributions, and treats candidates fairly. The claim that allocation using waiting time is fair is controversial. Some have claimed that formal lotteries are a fairer way to select among equal beneficiaries. We argue that lotteries are no fairer than allocation based on waiting time when it is equiprobable how a prospective queue will be ordered. In practice, lotteries share many of the disadvantages of queues; which is fairer will depend on contingent features of the allocation scenario. The upshot is that first-come, first-served is in fact a just way to allocate resources in many of the cases where it seems pre-theoretically compelling, and waiting time has unique normative properties which frequently justify its incorporation into resource allocation schemes. In all probability, future generations will outnumber us by thousands or millions to one. In the aggregate, their interests therefore matter enormously, and anything we can do to steer the future of civilization onto a better trajectory is of tremendous moral importance. This is the guiding thought that defines the philosophy of longtermism. Political science tells us that the practices of most governments are at stark odds with longtermism. But the problems of political short-termism are neither necessary nor inevitable. In (...) principle, the state could serve as a powerful tool for positively shaping the long-term future. In this chapter, we make some suggestions about how to align government incentives with the interests of future generations. First, in Section II, we explain the root causes of political short-termism. Then, in Section III, we propose and defend four institutional reforms that we think would be promising ways to increase the time horizons of governments: 1) government research institutions and archivists; 2) posterity impact assessments; 3) futures assemblies; and 4) legislative houses for future generations. Section IV concludes with five additional reforms that are promising but require further research: to fully resolve the problem of political short-termism we must develop a comprehensive research program on effective longtermist political institutions. The concept of artificial intelligence is not new nor is the notion that it should be granted legal protections given its influence on human activity. What is new, on a relative scale, is the notion that artificial intelligence can possess citizenship—a concept reserved only for humans, as it presupposes the idea of possessing civil duties and protections. Where there are several decades’ worth of writing on the concept of the legal status of computational artificial artefacts in the USA and elsewhere, (...) it is surprising that law makers internationally have come to a standstill to protect our silicon brainchildren. In this essay, it will be assumed that future artificial entities, such as Sophia the Robot, will be granted citizenship on an international scale. With this assumption, an analysis of rights will be made with respect to the needs of a non-biological intelligence possessing legal and civic duties akin to those possessed by humanity today. This essay does not present a full set of rights for artificial intelligence—instead, it aims to provide international jurisprudence evidence aliunde ab extra de lege lata for any future measures made to protect non-biological intelligence. Abstract: There are epistemic manipulators in the world. These people are actively attempting to sacrifice epistemic goods for personal gain. In doing so, manipulators have led many competent epistemic agents into believing contrarian theories that go against well-established knowledge. In this paper, I explore one mechanism by which manipulators get epistemic agents to believe contrarian theories. I do so by looking at a prominent empirical model of trustworthiness. This model identifies three major factors that epistemic agents look for when trying (...) to determine who is trustworthy. These are (i) ability, (ii) benevolence, and (iii) moral integrity. I then show how manipulators can manufacture the illusion that they possess these factors. This leads epistemic agents to view manipulators as trustworthy sources of information. Additionally, I argue that fact-checking will be an ineffective – or even harmful – practice when correcting the beliefs of epistemic agents who have been tricked by this illusion of epistemic trustworthiness. I suggest that in such cases we should use an alternative correction, which I call trust undercutting. (shrink)

One widely used method for allocating health care resources involves the use of cost-effectiveness analysis (CEA) to rank treatments in terms of quality-adjusted life-years (QALYs) gained. CEA has been criticized for discriminating against people with disabilities by valuing their lives less than those of non-disabled people. Avoiding discrimination seems to lead to the ’QALY trap’: we cannot value saving lives equally and still value raising quality of life. This paper reviews existing responses to the QALY trap and argues that all (...) are problematic. Instead, we argue that adopting a moderate form of prioritarianism avoids the QALY trap and disability discrimination. (shrink)

Many real-world agents recognise that they impose harms by choosing to emit carbon, e.g., by flying. Yet many do so anyway, and then attempt to make things right by offsetting those harms. Such offsetters typically believe that, by offsetting, they change the deontic status of their behaviour, making an otherwise impermissible action permissible. Do they succeed in practice? Some philosophers have argued that they do, since their offsets appear to reverse the adverse effects of their emissions. But we show that (...) they do not. In practice, standard carbon offsetting does not reverse the harms of the original action, nor does it even benefit the same group as was harmed. Standard moral theories hence deny that such offsetting succeeds. Indeed, we show that any moral theory that allows offsetting in this setting faces a dilemma between allowing any wrong to be offset, no matter how grievous, and recognising an implausibly sharp discontinuity between offsettable actions and non-offsettable actions. The most plausible response is to accept that carbon offsetting fails to right our climate wrongs. (shrink)

Dennett [1991] proposes a novel ontological account of the propositional attitudes—real patterns. Despite its name, the degree to which this account is committed to realism remains unclear. In this paper, I propose an alternative criterion of pattern instantiation, one that assesses the difficultly of faithfully interpreting a physical system as instantiating a particular pattern. Drawing on formal measures of simplicity and similarity, I argue that, for well-instantiated patterns, our interpretation will be computable by using a short program.
